These terms apply to every order placed at theicecross.com. The seller is Ice Cross Inc., a corporation registered in Ontario, Canada. Placing an order means you accept these terms.

US orders: duties and customs fees are already included in the price you see. We ship to the United States on a Delivered Duty Paid basis, which means we prepay all import duty and brokerage on your behalf. You will never be asked to pay anything to the carrier on delivery.
US prices are shown in US dollars and Canadian prices in Canadian dollars. You can switch currency at any time using the CAD/USD control in the site header. We don't currently ship outside Canada and the United States.
Delivery estimates are not guarantees. Once a parcel is handed to the carrier, transit time is outside our control. Weather, strikes and remote destinations can add time.
Check your address before you pay. We ship to the address entered at checkout. If it's wrong and the parcel is returned to us, we'll refund the item but can't cover the cost of reshipping.
Prices and taxes
Canadian orders are priced in Canadian dollars and exclude tax; GST/HST is calculated at checkout based on your delivery province. Children's clothing may qualify for reduced provincial tax, applied automatically where it applies.
US orders are priced in US dollars and include all import duty and brokerage. Any state or local sales tax is calculated at checkout where we are required to collect it.
We may change prices at any time, but never after you've placed an order.
Stock and order acceptance
We're selling remaining inventory, and quantities are limited. Stock shown on the site is updated periodically, not in real time.
Your order is an offer to buy. The contract forms when we dispatch. If an item turns out to be unavailable after you've paid, we'll tell you promptly and refund that item in full. We may cancel and refund any order at our discretion, including where a pricing error is obvious.
Payment
We accept Visa, Mastercard and American Express through Stripe. Payment is taken when you place your order. We don't see or store your card details — see our privacy policy.
Product descriptions
We describe our products as accurately as we can. Photography is of the actual product, but colours can vary between screens, and printed patterns vary slightly from pair to pair — that's normal for printed swimwear, not a defect.
Measurements in the size guide are approximate and taken flat. The waistband is elastic with a drawstring.
Returns
30 days, unworn, tags attached, hygiene liner intact. Return postage is paid by the customer, from either country. Duties paid on US orders are not refundable to us and are not returned. Full details on the returns page, which forms part of these terms.
Your statutory rights
Nothing here limits your rights under Ontario's Consumer Protection Act or other applicable Canadian consumer law. If a product is defective or not as described, you're entitled to a remedy regardless of anything above.
Limitation of liability
To the extent permitted by law, our liability for any order is limited to the amount you paid for it. We're not liable for indirect or consequential losses. This does not exclude liability for death, personal injury or anything else that can't lawfully be excluded.

Product photography, text and design on this site are the property of Ice Cross Inc. Please don't reproduce them commercially without permission.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Disputes fall to the courts of Ontario.
